Professorn Ned Foley i Ohio ska för några timmar sedan på Twitter ha kommenterat en artikel i magasinet New Yorker, som handlade om certifieringen av elektorsrösterna.
Han skriver att artikeln hade en felaktighet gällande Electoral Count Act. Det handlar om vad som händer ifall räkningen av delstaterna som ska ske imorgon, och som kommer att genomföras i alfabetisk ordning, inte blir klar fram till den 20:e januari.
Han säger att sannolikheten att det sker är extremt liten, men om det sker så går ärendet inte till representanthuset. Det 20:e tillägget i USAs konstitution säger att det den 20:e januari ska det finnas en ställföreträdande/tillträdande (acting) president.
Anledningen till att ärendet inte kan gå till representanthuset är för att samtliga elektorer inte har certifierats. Man kan inte gå vidare till att certifiera nästa delstat på listan innan samtliga tidigare är klara.

requires an Acting President; the election does NOT goes to the House, because the process still doesn’t have a full tally of electoral votes. Last sentence 3USC 15 is clear: the count can't move to next state until completing disposition of current state's electoral votes.
