Assange lawyer barred from questioning on alleged rape
Tuesday 15 November 2016 18:17 CET
A Swedish lawyer for Julian Assange said he was not allowed to be present during the questioning of the WikiLeaks founder over a rape allegation, as Swedish prosecutors completed a two-day interview inside the Ecuadorian embassy in London.
Lawyer Per E Samuelson told dpa he left London early on Tuesday after his client, an Australian citizen, was denied "the right to have attorney present."
Assange, 45, who has been living in the embassy in London for four years, denies the rape allegation and claims it is politically motivated, but has agreed to be questioned.
Both Assange and his Ecuadorian attorney had requested Samuelson's presence, but the Ecuadorian prosecutor did not agree.
"Assange faced the choice not to participate, which was my advice, or to proceed without me," Samuelson said. "He felt at the time it was necessary to proceed as best he could."
"It's a major flaw that questions were posed to him without a Swedish attorney present," he said. "I can only hope it went well."
The Swedish Prosecution Authority said it completed its questioning of Assange on Tuesday and that "the results of the interview will later be reported from Ecuador to the Swedish prosecutors in a written statement."
"After this report, the prosecutors will take a view on the continuation of the investigation," the authority said.
It said Ecuadorian and Swedish authorities "cannot provide information concerning details of the investigation" before the Swedish prosecutors make their decision.
Samuelson said he met Assange on Friday to prepare for the interview but had not spoken to him on Tuesday
The Ecuadorian lawyer who was present at the embassy was not familiar with the case details, he said
"Fifty-seven questions were posed about an event in Sweden where I know the facts and know Swedish law, and he was denied that right [to representation], which is serious," Samuelson said.
Assange's lawyer said he expects the prosecution to file a request to repeal a Swedish detention order now that Assange has given his account.
