Citat:
The PiS majority could have used their numbers to completely sideline the new judge or routinely outvote them. By waiting until a massive wave of terms expired, the government accumulated enough vacant seats to sweep in a block of 8 judges all at once, giving them a clear path to a mathematical majority over the remaining PiS judges
If Tusk’s coalition had quietly sent in individual judges one by one as vacancies arose, those judges would never have been allowed to take their seats. Waiting for a "tsunami" was a mandatory operational defense against two major roadblocks ...
Citat:
The Irony of the Pivot
This creates the exact paradox you are seeing: Tusk spent more than two years telling the public that the court was an illegal "masquerade". But because the judges serve immovable 9-year terms under the constitution, Tusk realized he couldn't just abolish the court by force.
Instead, the government pivoted. They waited until enough vacancies naturally opened up, elected their own block of 8 judges, and used those new judges to trigger an internal takeover—believing that populating the court with "lawful" judges was the only way to "heal" a broken institution from the inside out.
Citat:
So before Tusk's judges populated the court, he considered the court illegitimate
Yes, that is exactly correct. Donald Tusk’s government considered the Constitutional Tribunal completely illegitimate long before their own judges ever set foot in the building.
In fact, the Tusk administration's view was that the court wasn't actually functioning as a legal court at all, but rather as an unconstitutional political tool for the opposition.
