The court complaint says that the subpoenas are invalid because the state Legislature only has the right to subpoena in certain instances.
That includes if the subpoena is authorized by ordinance or similar enactment, if it serves a valid legislative purpose, and if the witnesses or material subpoenaed are pertinent to the subject matter of an investigation.
None of these are the case, according to the complaint. The subpoenas are not authorized by any statute or other law, there is no legislative authority to audit election results, examine ballots, or conduct elections, and there is no relevant investigation, the complaint states.
The complaint also states that turning over the ballots and ballot images to the committee "unquestionably compromises the secrecy of the ballots," required under state law, and violates the state law that requires the county to keep the ballots "in a secure facility managed by the treasurer, who shall keep it unopened and unaltered," for a certain time frame.
"These deficiencies, the unreasonable notice, and the unsupported threat of contempt — and the implicit threat of imprisonment that comes with it — evidences a draconian abuse of power in an attempt to obtain the personal information of voters, voting records, ballots, and tabulation machines," the complaint states. "These are all things that the Senate has no right to possess, and some of which would be illegal for them to possess."
The Senate issued the subpoenas on Tuesday, the day after a six-hour Judiciary Committee hearing on the election that included county officials.
The hearing did not turn up any evidence of fraud or widespread problems and many of the questions asked by lawmakers were queries about basic procedures in place long before the election. Other questions stemmed from claims that officials could quickly fact check. When committee members asked about observers, election officials said there were more observers involved this year than in any previous election and described in detail the areas and processes they could observe.
