Hi, I post in English because is not clear for me in Swedish.
I worked for Adecco for 1.5 year in different compagnies but my profile dosen't fit their expectations : I'm not enough strong for the jobbs or not immediately effective,anyway, after my last try one week ago my boss called me an explained that they haven't jobbs for me anyore and so I don't have my GLF/Garantilön BUT i'm still under my contract (tillsvidare) with them and I have to find a jobb by myself.
I wrote an email to say that I can't live a long time without a salary or GLF and so I ll need to stop the contract to be able to have Akassa.
Thay answered that I do as I want but they didn't mentioned that THEY will stop my contract....

I don't understand why they keep me in this situation...Is that legal ?
I don't want to pay a membershipt at Unionen for only this question so if you could help me with that...I can give the collective agreement if you need.

You have a work contract that say you can keep working, but your boss said that you no longer exceed the expectation of the company, and you have no job now, is that it?
So, the first contract must be signed by your boss, so he's aware that is your right to continue working for *any number* years, right? we don't know if the contract say something else, but only by this information it could be consider "breach of contract", and you can sue your boss, and win the cause.

Do provide the agreements you have signed with the company, otherwise there is not much help to give you - we cannot know what you have signed.

But to answer your question - yes they can keep you in a contract without giving you any work to do.
However, this may be a breach of contract - as said above, do provide those documents.



Furthermore, you may be eligible for a-kassa if you simply " walk away "- the contractor clearly have said there is no work for you to do and will not be able to provide any work.

Contact the union in regards of this, you do not have to pay a fee.

A-kassa kräver en viss mängd arbete tillsammans med en anslutning till kassan under den perioden.

TS ska vara glad att han har haft ett jobb, nu kan TS åka hem till sitt egna land, tack.

Rimligen, en person som, utifrån inlägget att döma: har fått sitt första jobb i Sverige, sannolikt inte är svensk medborgare (vilket vidare omöjliggör att vara med i a-kassa) och inte i sin trådstart nämner en anslutning till en a-kassa … denna person kan man förmoda saknar anslutning till a-kassa. Inte en personlig åsikt, snarare en slutledning.

Hi,
so here all what I can provide.
I know I have the right to A kassa I pay my membership for that but I know also that if it's me or my employer who stop the contract it's not the same for the payment waiting times etc...

According to the papers you provided you are entilted to the amount set as garantilön. If they cant rent you out to a company that is their problem.
Are you a member of a Union? If you are contact them asap.
If you are not it will be more difficult but my understanding is that you are entiled to the money. Ask the employer for a signed paper stating on what grounds they are are refusing payment of your salary (this is mostly to make them pay up or for you to use as evidence so they don´t come up with some bullshit later). If they don´t start paying up you will have to make a claim with kronofogden to get the salary.

hi , I had a meeting with them and now it's okay I have my garantilön !
But they still don't want to brake the contract because they never had my case before, we will have another meeting next wek.
