The prosecutor has applied for a detention order in the Case.

The detention hearing will be held on June 3rd, 2019 at 10.00 am at Uppsala District Court. The Court has taken into consideration both the requirement of a speedy procedure and the right for the suspect to prepare his defence, when deciding the date for the hearing.

Bars to Extradition
The statutory bars to extradition apply to all cases, even if there is no explicit clause in the relevant treaty.

If the judge finds that any of the bars to extradition apply, the requested person must be discharged.

The statutory bars to extradition include the following:

Citat:
Double Jeopardy - whether the person has already been prosecuted for the same offence;

Absence of Prosecution Decision - whether the prosecution case against the accused is sufficiently advanced;

Extraneous Considerations - whether the request for extradition is improperly motivated and there is a risk of prejudice to the requested person;

Passage of Time - whether extradition would be unjust or oppressive in light of the amount of time that has passed since the offence or since the person has been unlawfully at large;

Age (EAW cases only) - whether because of age, the requested person could not be guilty of the offence;

Hostage-taking Considerations (non-EAW cases only) - whether the requested person would be unable to communicate with protective authorities and the extradition offence falls under the Taking of Hostages Act 1982;

Death Penalty (non-EAW cases only) - whether or not the requested person could be sentenced to death for the extradition offence in the requesting state;

Specialty - prevents the requested person from being dealt with in the requested state for offences other than those for which they have been extradited;

Earlier Extradition from Territory / by the International Criminal Court (‘ICC’) - whether the requested person was previously extradited to the UK from another country or by the ICC to serve a custodial sentence and no consent has been given by that country or by the ICC President for further extradition;

Forum - whether it would be in the interests of justice for the requested person to be prosecuted in the UK instead.

Citat:
Firstly, by entering the Embassy, you deliberately put yourself out of reach, whilst remaining in the UK. You remained there for nearly 7 years, exploiting your privileged position to flout the law and advertise internationally your disdain for the law of this country. Your actions undoubtedly affected the progress of the Swedish proceedings. Even though you did co-operate initially, it was not for you to decide the nature or extent of your co-operation with the investigations. They could not be effectively progressed, and were discontinued, not least because you remained in the Embassy.

Extradition hearing

The extradition hearing should normally begin within 21 days of arrest.

The judge must be satisfied that the conduct described in the warrant amounts to an extradition offence (including, in almost all cases, the requirement that the conduct would amount to a criminal offence were it to have occurred in the UK, and minimum levels of severity of punishment), and that none of the statutory bars to extradition apply.

Källa på att åtal krävs för EAW?

Så här ser de formella reglerna ut:

1. rule against double jeopardy

2. the absence of a prosecution decision (whether the prosecution case against the accused is sufficiently advanced)

3. extraneous considerations (whether the request for extradition is improperly motivated)

4. passage of time

5. the requested person’s age

6. speciality (the requested person must only be dealt with in the requested state for the offences for which they have been extradited)

7. onward extradition (where the requested person has previously been extradited to the UK from a third county, and consent for onward extradition from that country is required but has not been forthcoming)

8. forum (whether it would be more appropriate for the requested person to be prosecuted in the UK instead)

The judge must also decide if extradition would be disproportionate or would be incompatible with the requested person’s human rights. If the judge decides it would be both proportionate and compatible, extradition must be ordered.

Lite intressant mellanväg, under förutsättning att EAWn godkänns i första läget enligt inläggen ovan.

Serving an Existing Sentence in the UK

If the requested person is serving a sentence in the UK, the court has the discretion to:

Adjourn extradition proceedings until that sentence has been served; or
Consider temporary transfer of the requested person to the requesting state.

Temporary transfer will be subject to the receipt of undertakings as to the status of the requested person during the period of temporary transfer; for example an undertaking that the requested person will be remanded in custody whilst in the requesting state and will be returned to custody in the UK at the conclusion of the foreign proceedings.

the institution and conducting of legal proceedings against someone in respect of a criminal charge
