A warm welcome to the incoming class of Republican Senators.

Amid the blur of lawsuits and noise around the recount in Florida’s Senate race lies a possible outcome that could be the ultimate twist: Senator Bill Nelson may not win the election, even if he wins the election.

That is because the Constitution says that the ultimate arbiter of who gets a Senate seat is the Senate itself — not election officials or the courts.

That would not seem to bode well for the Democrats or their incumbent, Mr. Nelson. Though he trails his Republican opponent, Gov. Rick Scott, the margin has dwindled to about 13,000 votes; Mr. Nelson hopes to make that up in the recount and take the lead.

If that were to happen, though, it is not unthinkable that Republicans would consider using their majority power in the Senate to refuse to seat Mr. Nelson and to give the seat to Mr. Scott instead — especially considering how he and his party have repeatedly insisted, without offering evidence, that the ballot review process has been riddled with fraud and misconduct.

Unofficial Florida election results show that the governor’s race seems to be settled after a machine recount but the U.S. Senate race is likely headed to a hand recount.

Unofficial results posted on the Florida secretary of state’s website show that Republican Ron DeSantis is virtually assured of winning the nationally watched governor’s race over Democrat Andrew Gillum. Florida finished a machine recount Thursday that showed Gillum without enough votes to force a manual recount.

The margin between U.S. Sen. Bill Nelson and Gov. Rick Scott is still thin enough to trigger a second review. State law requires a hand recount of races with margins of 0.25 percentage points or less.

Counties have until Sunday to inspect the ballots that did not record a vote when put through the machines. Those ballots are re-examined to see whether the voter skipped the race or marked the ballot in a way that the machines cannot read but can be deciphered.

The election will be certified Tuesday.

A federal judge is refusing to suspend looming election recount deadlines in the battleground state of Florida.

U.S. District Judge Mark Walker on Thursday rejected a request by U.S. Sen. Bill Nelson and Democrats to give counties more time to finish recounts. All 67 counties are required to submit the results of a machine recount by 3 p.m.

Palm Beach County’s election supervisor has already warned that the county will not be able to finish on time.

In his ruling, Walker said he was concerned that some counties may not complete their work by the deadline. But he said there is a lack of information on when Palm Beach County would wrap up its work.

Walker said he cannot “fashion a remedy in the dark.”

Stacey Abrams’ campaign is preparing an unprecedented legal challenge in the unresolved Georgia governor’s race that could leave the state’s Supreme Court deciding whether to force another round of voting.

The Democrat’s longshot strategy relies on a statute that’s never been used in such a high-stakes contest. It is being discussed as Georgia elections officials appear to be on the cusp of certifying Republican Brian Kemp as the winner of a bitterly fought campaign that’s been marred by charges of electoral malfeasance.

Top Abrams advisers outlined her prospective case to The Associated Press, stressing that the Democratic candidate hasn’t finalized a decision about whether to proceed once state officials certify Kemp as the victor. That could happen as early as Friday evening.
