• 34,448 duplicates
• None of the various systems related to elections had numbers that would balance and agree with each other. In some cases, these differences were significant.
• There appears to be many 27, 807 ballots cast from individuals who had moved prior to the election.
• Files were missing from the Election Management System (EMS) Server.
• Ballot images 284,412 on the EMS corrupt or missing.
• Logs appeared to be intentionally rolled over, and all the data in the database related to the 2020 Election had been fully cleared.
• On the ballot side, batches were not always clearly delineated, duplicated ballots were missing the required serial numbers, originals were duplicated more than once, and the Auditors were never provided Chain-of Custody documentation for the ballots for the time-period prior to the ballot’s movement into the Auditors’ care.
• Maricopa County failed to follow basic cyber security best practices and guidelines from CISA© 2021 Cyber Ninjas Page 2 of 4
• Software and patch protocols were not followed
• Credential management was flawed: unique usernames and passwords were not allocated
• Lack of baseline for host and network activity for approved programs, communications protocols and communications devices for voting systems
• Canvass showed over 3,400 more ballots were casted than recorded
• Over 9,000 more mail-in ballots were received and recorded than the official number of mail-in ballots sent out by the county
• Approximately 2,500 ballots were shown in the early vote returns that do not have a voter listed as casting them.
• Over 255,000 early votes shown in the county final vote file that do not have a corresponding entry in the early voting returns file
• Over 23,000 voted by mail after moving after the October 5th cutoff
• 2,382 voters casted votes in Maricopa county, in person, after moving out of the county

NOTE: At an earlier hearing it was stated that there were 74,243 entries in EV33 Early Voting Returns Files without a corresponding entry in the EV32 Early Voting Sent Files. This was brought up in the context of justification for performing canvassing to further validate the reasoning for this discrepancy. While this discrepancy is accurate, it was unintentionally misleading. All but 397 of those entries were Early Voting in-person votes which also generate an EV33 entry in addition to mail-in ballots.

NOTE: We’ve been informed shortly before the release of this report that some of the discrepancies outlined could be due to the protected voter list. This has not been able to be validated at this time, but we thought it was important to disclose this information for accuracy.

5 .7. 4 EARLY VOTES NOT Acc UNTED FOR IN EV33
The EV33 Early Voting Return Files do not contain entries for 255,326 Early Voters which are recorded in the VM55 Final Voted File. Individuals that vote as part of Early Voting, either by mail or in person, should have an EV33 entry related to their casting of a vote containing details as to when and how that vote was cast. Without an EV33 these details are unavailable, and it could make some types of audits impossible.

False Myth 1: 74,000 more mail-in ballots were counted in the November 2020 General Election than were sent. FALSE
FACTS: Voters in Maricopa County may vote early or on Election Day. If a voter chooses to vote early, they may cast a mailed ballot or vote in person prior to Election Day. In both of these cases, the voter is casting an early ballot. For the November 2020 General Election, Maricopa County had 2,364,426 requests for an early ballot and 1,918,024 early ballots returned either by mail or voting in-person early.
The claim that Maricopa County had 74,000 more mail-in ballots than requests appears to be incorrectly calculated by comparing two files that are created during early voting, the EV32 and EV33 files. Created daily, the EV32 file is a listing of all voters that requested an early ballot on that day, while the EV33 file is a listing of all voters that returned a ballot on that day. State law requires the County prepare these daily files for the County political parties during early voting. The EV32 file must be created up until 11 days prior to Election Day, which is the last day a voter can request a ballot in the mail. The EV33 files must be created up until the day before Election Day.
Any voter who cast an early ballot in person after Oct. 23, 2020 would not be included in the EV32 file and any voter who dropped off an early ballot on Election Day would not be included in the EV33 file. Any comparison using these files to find the total number of early voters would lead to inaccurate results. The “voted file” provides the full accounting of voters that cast a ballot in Maricopa County.

In addition, the EV32 Returns & EV33 files are not the proper files to refer to for a complete accumulating of all early ballots sent and received.
